I was out ranking on some big mobs (compared to me), let's say feared swordsmen and we were doing xp on them. Then a necromancer passes by out of any of our ranges, but he starts summoning more feared swordsmen over to us as soon as we start af fight, killing one of my groupmates.

Now did the necromancer break the rule about not killing out of range?
