I think that the idea where a paladin can set a skill that let's them stop before they kill someone is a great idea, but why not give it to everyone? It would expand roleplaying a great deal, for instance... There are many times when I really didn't want to kill a person, but had no real roleplaying choice, I couldn't let them walk away per se. And if your only after someone's gold or eq, you don't have to kill them to get it if you have a merciful streak. (Or maybe you see yourself as a thief not a murderer kind of thing) Anyway, I think it would be a great addition, and wouldn't give any more power to anyone. I mean, is there anyone that would rather be killed than knocked out and have a decent chance of living?
If I am an evil warrior or thief looking for loot, I could attack you and everything would go normaly until I delt a killing blow, but it wouldn't kill you, just knock you out cold. I could take anything from your body as if you had died, or kill you, or someone else could come and kill you. You would be pretty vulnerable, but not dead. In about 5 or so hours, you would come to, and limp back to town not having died at all. Of course bleeding plague poison etc would kill you after first hour because you have 1 or no hp.
