Theoretically it depends on if they were outside of town "chasing a criminal." Of course, like with all things in life, you are going to find some people who abuse this. I have never heard of a group of three evils at rank 28 in Eriagon chasing criminals, but when you smoke that arbiter and take all his stuff and disrupt his ranking group? Well, you see my point, as cynical as it may be. On the other hand, when outside of town do not think that arbiters wont hesitate to smoke you too :)
