Much as with a civil trial in real life, the burden of proof is the "balance of probabilities." For anyone who says you need hard-core, 100% proof, you're, well, dead wrong.

Arbiters can, and will, flag based on strong probabilities. If the Arbiter is sure you did it, and circumstantial evidence points to you, he's quite likely to flag -- even if someone wasn't standing there, watching.
