I believe that the whole point of Cabal items is to actively give the playerbase something to care about... whether it be defending/retrieving their own, or stealing other's.

I feel your pain. Perhaps you can offer to go retrieve with whatever Citizens are in Thera at the time. It's tough, true, but I do believe that giving the Empire the ability to oath without the item is a bad move. "They would be able to oath even without the Codex." is basically what you said... Think about it from another viewpoint and you'll see that that's exactly why it shouldn't be changed to work like that.
