If we legalized all drugs tomorrow, all the people in jail for drug sentences wouldn't just get to walk free, unless the courts decided to apply the laws retroactively, which they declined to do in this case. <br> <br>The laws changing in no way excuses breaking the laws that existed at the time of your crime. Likewise, if you commit a crime that goes from being a misdemeanor to a felony, they cannot retroactively increase your sentence once it is handed down.
