Sure, it may not be *fair*, but nothing really is. Consider this real-life analogy:

Person A attacks, brutalizes, and nearly kills Person B. There are many witnesses. When Person A is called into court, his defense is "Person B was stealing from me." There are no witnesses for the stealing. Who do you think will be punished?
