What you may *not* do is assist the criminal he's after. That is still a crime, no matter where it takes place. Assistance included rescuing, healing, returning weapons to, granting beneficial spells or communes, etc. etc. Doing any of these things *will* earn you a flag, no matter where you are.

I'm not 100% sure what the rule is with the guards; that's always a bit of a trickier issue. Are you assisting the level 30 rager by killing the level 41 guards? The Arbiter himself certainly can't hurt the criminal, so by killing the guards you're making it so the criminal can't die... I'd say that you're better off not to chance it if you can avoid it.

The current books in the new arbiter cabal describe the situation in pretty good detail.
