Here's why we lose exp for dying to guards::

First off, their mobs. *chuckle*
Easy enough.
Secondly, if you dind't lose exp for dying
to guards, and just lost con (Provided you'd
stashed your eq somewhere safe beforehand),
crime would be absolutely *RAMPANT*. You see
someone weak in town. He's got a pair of wide
coppers and granite rings that you think would
look just dandy on your level 20 warrior. Ok, no
big deal. Bash him to death, run and dump the
stuff in the sewer somewhere, turn yourself in,
bada bing bada boom, you got something most level
20 warriors would trade their third nut for, and you
only paid 1/3 a point of con. No Exp hole. No lost gear.
I think the fear of Exp holes and lost gear is the only
thing that keeps most people in line as it is. This much is
obvioused by the fact that most hero's in Thera could give
a flying fudge about the laws. You find a paladin you dont
like in town, you smack the hell out of him, get wanted, go
die to grazar. No big deal. Well, that's just my 2 and a half
cents worth. Flame on
