I have been on both sides.

I remember a long time ago someone asked for some help from a cleric of mine. I played a dark-elf and he was a lowbie storm giant paladin trapped in the sewers. I said sure, walked to red dragon, asked him to allow me to summon, then proceeded to spam summon on him until he was dead. Good, bad? well, when he asked me for help, he was no longer an innocent bystander. At that point I was justified in doing something to decide his fate.

More recently, I recall playing a lowbie mage adventuring in the Elemental Canyon, minding my own business. I see Rybiskus run by and proceed to a chamber of an elemental ruler. A few minutes later he returns and stands next to me. Doesnt say anything, does do anything but wait. (I had no idea what he was doing.) Along comes the ruler and BAM! area spell. Coincidence, accident...I dont think so. Clearly a plan to use a mob to kill someone out of his range. In this case, Rybiskus violated the rules. He used a mob in an attempt to kill out of range. He didnt summon, but he did track the mob. The attack was blatant, premediated and my char was an innocent bystander.

In another case, while playing Agorinth, I had an earth elemental with me and I was harrassing the Haven. While fighting, my elemental earthquaked and his attack reflected upon me. The elemental stopped following me and continued to fight the phoenix. There were some young ones around and as the elemental continued to quake they started getting hit. Completely accidental and something I had no idea was going to happen. Noone died, but they were hurt. Later(it may have even been a day later) I was transfered by an immortal and berated harshly. I explained it was an accident, that I had used them before and it had not happened but the immortal would not stop until I promised that nothing like this would ever happen again.(A rather ridiculous request considering the circumstance but I had to agree.) In this case I did not think I had broken the rules at all but the immortal felt very strongly that I did.

The point of all this is that there is a big grey area in the rules and that the Immortals decide exactly how to interpret the spirit of the rules. As I see it they are going decide if an attempt was made by a player to kill an innocent bystander out of his pk range.

Like The Arcane, in this specific case the victim deserved what he got and I think most immortals would agree. When he started following Zorszaul he was no longer an innocent bystander.
