I'm not sure what you mean by the claim "spells don't fail at 100%." If you mean the mage doesn't accidently say the wrong words and botch up the spell, then you are correct. If you mean that the spell always does what it's supposed to, then you are wrong.

Both skills and spells inherently involve TWO people, the attacker and the attacked. Sleep/halt/hold spells can all be saved vs, with spellbane simple damage spells can be saved against, etc. If you get, say, whirl or pincer to 100%, you ALWAYS execute that move correctly: there just isn't any gaurantee that the victim won't dodge or parry or somesuch.
