Arbiters are not neutral.

You have provided the argumentive style known as "slippery slope". Your arguement is invalid.

And I don't care about their powers. By their actions they have entered themselves a viable target and their lack of an item only aids them in their aggression.

An analogy: a child swings a sharp sword at your arm you don't let them hit you, you avoid the strike if you can and tell the child not to do that. If the child persists and attacks you viciously without remorse then they have subjected themselves to enemy status and all the power and responsibility that such a status bears.
