Without con/xp loss from deaths, anyone could hero a character by pure perseverence. (It's still not so hard to get there if you really want it.) If you are taking mob deaths regularly, trust me when I say the hero-range ranks aren't going to be much fun for you. The players there are more skilled (on average) than the lower ranks, and have a nastier tool kit for making your life nasty, brutish, and short. (Air majors, nightgaunts, frightful fiends and the like are devastating against players who have not learned to counter them.)

It's a learning curve. Mob deaths should be rare unless you are exploring, testing a new class out, flaunt the law, or have bad luck against Sylvans and the like. Until you can handle the nasty yet incredibly dumb mobs of Thera, you don't want to take it up a notch and rank into the 40's.
