Pointing out to someone that they are breaking role to me is border line going OOC.

If someone wants to break role, so be it. I get it's frustrating when a berserker breaks parity or an imperial breaks Imperial law but it is what it is. Let them hang themselves by their own rope. Maybe they have an IC reason for doing it. Maybe they're just a douche. Either way it's not your characters place to tell them how you think they should be behaving.
