So my fiance has most of her student loans through Sallie Mae. She has been paying them (overpaying them usually) for 2 and 1/2 years.
Before xmas time we quit paying extra so we'd have some extra money. Her Employer gives her a $200 check to her student loan company every month, for over a year and a half. So instead of paying 335 or whatever, she'd send a check from our personal account for 150-200 and her employer's check for $200.
So one day she got a call, saying her account was past due. After a few phone calls and a lot of stress later, she found they deposited the money, they just didn't credit it to her account.
So she had to fax a copy of the check from her Employer's bank, proving that she paid the $200.
The next few months she put her account number on the checks. As soon as she did this, she got calls from collections every month saying her loans were past due. She again had to fax another copy of her Employer's check, resolving(HA) the problem. This went on for 2 months.
This week she got phone calls, saying that her account past past due AGAIN. After the first person talked to her, he said he'd talk to processing and figure out what the problem was, apologize, etc. He told her that would figure out what is going wrong, and make a note on her account so that nobody would call her until she calls him on Friday, or he calls when the issue is resolved. He never called.
Well two more times this week, she has gotten the same call about a delinquint payment. They call at 8AM, when we sometimes work untill 11-12. So literally after 4 hours of sleep they call and wake her and threaten to garnish her wages, take her car, and drop her (701!) credit score, etc.
Today, one person finally called and after being a dick for 30 minutes, interrupting her every time she spoke, she finally told him what the issue was. He put her on hold for 20 minutes, and he told her the account # on her employer's check was wrong. He THEN continued to say she owes two months of late payments and is threatening to report her to the credit bureaus and garnish her wages.. She asked to talk to processing or a supervisor or anyone who could could resolve this,and he ignored her and hung up (just like 1/2 of the other people when she can prove they are wrong).
I looked it up, and 1 number is off on the account # of the check. They now say she owes $400 in delinquint payments, + whatever they charge for late charges.
Once this is resolved, what are our options? If this affects her credit score, is there any recourse she can take to correct it? Does she have to pay the late charges over a typo from our employer's bookkeeper?
And as a side note, she sent $200 checks to her student loan company with NO account number in the same envelope as her personal check for over a year before this became on issue. She still sends the checks together, just 1 number is wrong on the account number.
Would that constitute harrasment? She has lost more sleep over this than any one person should. Also, she eats xanax like candy and is almost in tears when these people bully her. She's not looking to sue, but I think something needs to be done. Any time she can actually talk them into a corner they hang up.
