CON is no big deal, it takes a truly determined player to even get close to con-death, almost everyone deletes long before then. It doesn't even affect your hp gains anymore (thank god).

Most deaths you won't even lose equipment, its only against other players that it happens and even then, most players are too lazy or too overburdened to take much, you'll generally lose 2-3 pieces a death if you're well-equipped, plus some gold, all of which is easily recoverable in an hour or less. Dying to a mob is even less of a problem, all you lose in maybe half an hour to an hour's worth of exp, but you're still operating at full capacity with all your equipment.

Unless you're losing full hero-level sets every time you die, I have difficulty seeing the problem.
